Terms and conditions of sale
This is a translation provided for convenience. Only the French version is legally binding.
Version 2026-08-31. This is the reference recorded with your order at the moment you accept these terms and conditions: a later revision does not change what you accepted on that day.
1. Purpose and status of the Customer
These general terms and conditions of sale (the "Terms", in French "CGV") govern the sale and use of the qzaco service (the "Service"), published by CAP-REL, whose contact details are given in the legal notice.
The Service is offered to professionals, for the purposes of their business. By ticking the box provided for this purpose at the time of payment, the Customer accepts these Terms without reservation and declares that the order is placed for the purposes of its professional activity. The date of this acceptance and the version of the Terms then in force are recorded with the order.
2. The Service
A qzaco sticker bears a unique QR code and a unique web address, engraved to last. Scanning this code opens a page with three levels:
- a public level, readable by anyone who scans the sticker;
- two protected levels, whose content is displayed only after entering a password chosen by the owner of the sticker.
The Customer itself describes what the sticker identifies: a title, the texts of the three levels, up to ten photographs. It may attach a maintenance due date to the sticker, which may be recurring, and receive an email reminder before that date.
3. Account and proof of address
Creating an account is free of charge and entails no commitment. No activation, no payment and no recharge code is possible until the email address of the account has been proven through the link sent upon registration.
The Customer is responsible for keeping its account password confidential. If it is forgotten, a single-use reset link is sent to the Customer on request.
4. Prices and payment
The activation of a sticker is invoiced at €5.88 incl. VAT, i.e. €4.90 excl. VAT. The prices in force are those displayed at the time of the order.
Payment is made online. No payment is collected on qzaco itself: the order is handled by the publisher's billing channel, on a payment page separate from the Service, and no bank details of the Customer are kept by the Service. The invoice is issued in the Customer's name as soon as the payment has been received.
Batches of activations may be purchased separately. They are credited to the Customer's account by means of a recharge code and are then used sticker by sticker, with no further payment. The sale of these batches and that of the physical stickers are governed by the terms and conditions of the shop where they take place.
The Service is payable in advance: no activation takes place before the payment has been received, and therefore no sum is ever claimed from the Customer afterwards.
5. Term: ten years per activation
An activation opens a period of 10 years starting from the day the sticker is activated. During this period, the page is readable by anyone who scans the QR code and editable by its owner.
The Customer is notified by email one year, three months and then one month before the expiry date. It extends the period by using a new activation from its account area; the new period runs from the expiry date and not from the day of the action, so that extending as early as the first reminder does not cost the remaining days.
6. What happens at the expiry date
Nothing is deleted. Once the expiry date has passed, the page is archived: the public page still responds when scanned, its content remains readable, a banner indicates that the sticker is archived, and only editing is closed. The Customer regains the right to edit by extending.
This archiving is the counterpart of a ten-year promise: a sticker affixed to a cabinet must never lead to a dead page, including when its owner has stopped paying.
7. Withdrawal
The right of withdrawal under articles L221-18 et seq. du Code de la consommation (French Consumer Code) is reserved for consumers, meaning natural persons acting for purposes outside the scope of their commercial, industrial, craft, liberal or agricultural activity. As the Customer contracts for the purposes of its professional activity (article 1), this right does not apply to this contract.
In addition, the Service is performed immediately: the sticker is activated as soon as the payment has been received, and the Customer expressly accepts this immediate performance by paying for its order.
8. Content published by the Customer
The Customer is the sole author of what it writes on its pages and solely responsible for their content. It undertakes not to publish any unlawful content or content that infringes the rights of a third party, and is answerable for any personal data concerning third parties that it chooses to include.
It is up to the Customer to decide what it places on the public level, readable by anyone who scans the sticker, and what it reserves for the protected levels.
Level passwords contain at least six characters. The Customer does not reuse its account password, and chooses a new one as soon as the password of a level has circulated beyond the persons for whom it was intended. A level opened on a device closes by itself after thirty minutes, and the button provided for this purpose closes it immediately.
9. Availability and liability
The publisher is bound by an obligation of means (best-efforts obligation) as regards the availability and proper functioning of the Service. It does not guarantee uninterrupted access: an interruption may result from maintenance, a technical incident or the act of a third party. It is liable for direct damage caused by a breach of its obligations, under the conditions of ordinary law; indirect damage is excluded.
The publisher backs up the Service in order to be able to restore it after an incident. These backups are not the Customer's archives and are not returned to the Customer item by item: a Customer who cares about a piece of content keeps a copy of it on its own side.
No provision of this article may exclude the warranties and liabilities from which the law does not permit derogation, nor deprive of its substance the essential obligation of the publisher, which is to keep the page readable for the duration sold.
10. Removal of content and closure of an account
The publisher may remove manifestly unlawful content that is reported to it under the conditions described in the legal notice, and close the account that published it. Such a removal does not give rise to any refund.
11. Personal data
Personal data are processed in accordance with the General Data Protection Regulation. Details of the data collected, the purposes, the retention periods and the Customer's rights are set out in the privacy policy, which forms an integral part of these terms and conditions.
12. Intellectual property
The publisher holds the copyright in the Service. This ownership does not entail any general prohibition on reproduction: the publisher has chosen free software and grants in advance, to any person, the rights described below. Two distinct regimes apply.
The source code of the Service is free software, published under the GNU Affero General Public License (AGPL), version 3 or any later version published by the Free Software Foundation. Everyone has the right to use, study, modify and redistribute it under the terms of this license, which notably requires derivative versions to be placed under the same license and their source code to be offered to users who interact with them remotely. The code is published at https://inligit.fr/cap-rel/qzaco and the official text of the license at gnu.org. The content committed to this repository is covered by this license, including the presentation pages of the site.
The name qzaco, the CAP-REL trademark and the visual identity of the Service (name, logo, style guides) are not covered by this license and remain reserved. In accordance with section 7 of the AGPL license, the right to reproduce and modify the code does not entail any right to use these distinctive signs: a derived instance must be operated under another name, so that it cannot be confused with the Service operated by the publisher.
These freedoms apply to the software, never to the content: the texts and photographs that the Customer places on its pages belong to the Customer. The publisher hosts them, acquires no right in them, does not exploit them and makes them readable only within the limits chosen by the Customer itself, one public level and two protected levels.
13. Revision of these terms and conditions
Each version of these terms and conditions bears a reference, shown at the top of this page and recorded with each order. A revision applies only to orders placed after it has been published online: it does not change what has already been accepted.
14. Applicable law and dispute resolution
These terms and conditions are governed by French law.
In the event of a dispute, the Customer is invited to contact the publisher first, through the contact form indicated in the legal notice, in order to seek an amicable solution. Failing agreement, the dispute falls within the jurisdiction of the courts designated by the ordinary rules of jurisdiction: the publisher does not stipulate any jurisdiction clause.
